The Mental Health Law Clinic is a joint project of QPILCH and the University of Queensland’s TC Beirne School of Law to provide free legal services to disadvantaged people seeking assistance in mental health law. It is staffed by senior law students under the supervision of an experienced lawyer.

The Clinic’s primary focus is to provide assistance in matters before the Mental Health Review Tribunal and legal problems arising from the application of the Mental Health Act 2000 (Qld).

Time permitting, the Clinic may also assist people who are experiencing problems in the following areas of law because of their mental illness:

Centrelink or other social security issues;
Consumer issues;
Debts, loan agreements and bankruptcy;
Discrimination;
Employment;
Fines, infringement notices and enforcement warrants issued by the State Penalties and Enforcement Registry (SPER);
Guardianship or administration issues;
Housing and tenancy issues;
Police powers.

Type of assistanceBack to top

The Clinic can:

Provide advice regarding rights and obligations;
Draft documents on behalf of the client such as letters, tribunal documents and submissions;
Conduct legal research and community education.

The Clinic cannot represent you before a tribunal or a court. However, if appropriate, we may be able to refer your matter for pro bono legal assistance to a law firms or barrister under one of our referral schemes.

Eligibility for assistanceBack to top

In order to receive the assistance of the Clinic, the applicant must be either:

A non-profit association; or
An individual who cannot obtain legal aid and cannot afford to pay for legal assistance.

We reserve the right not to provide assistance to persons whose case lacks legal merit.
